Basin Man Changes Plea, Sentenced in District Court

A Basin man changed his plea to an amended charge and was sentenced Thursday in Fourth Judicial District Court in Sheridan. Sheridan Media’s Ron Richter has the details.

Basin Man Changes Plea, Sentenced in District Court

On December 13, 2021, a jury trial scheduled in Fourth Judicial District Court in Sheridan for David Briscoe of Basin was continued because of an outburst by the defendant. Briscoe’s bond was revoked and he was remanded to the custody of the Sheridan County Detention Center at that time. The trial continuation in December was the second time Briscoe’s trial was continued at the last minute. In October of last year, Sheridan County Deputy Prosecuting Attorney Christina White learned during the last few days of trial prep that the exact date the alleged crime occurred differed from what was originally part of the prosecution’s case. The new information caused the State to subpoena a new witness just before the start of the trial, which caused the continuation. Briscoe was charged with felony aggravated assault and battery for an incident that occurred in November of 2020 in the parking lot of Taco Bell in Sheridan where Briscoe allegedly threatened an individual’s life after he pulled up his shirt to reveal a firearm in his waistband.

Briscoe, at a change of plea hearing Thursday in District Court said the incident took place in the Wal-Mart parking lot and that he did not have a gun in his waistband. Prosecuting Attorney White said if the case had gone to trial, three witnesses would have testified that Briscoe did brandish a firearm and threatened a then 17-year-old with bodily harm. Briscoe, at Thursday’s hearing, pursuant to terms of a plea agreement reached with the State, pleaded guilty to an amended charge of reckless endangerment, a misdemeanor. District Court Judge William Edelman accepted the plea deal and sentenced Briscoe to 365 days in jail with all but 60 days suspended and 60 days of credit for time served. Briscoe was placed on one-year of supervised probation and was ordered to pay $420 in various court costs and $1,500 in attorney fees.
