On April 12, 56-year-old Alan Crackenberger was sentenced in 4th Judicial District Court in Sheridan for the charge of delivery of a controlled substance methamphetamine. Approximately two hours after the sentencing hearing, Crackenberger tested positive for alcohol while being booked into the Sheridan County Detention Center to serve his jail sentence. Due to the positive test, Sheridan County Attorney Dianna Bennett filed a motion to hold Crackenberger in contempt of court for lying about being under the influence of drugs or alcohol at the April 12 sentencing hearing.
District Court Judge Darci Phillips, at a hearing this week, said the court was bound to dismiss the motion without prejudice because the Wyoming Rules of Criminal Procedure requires that the state pursue the contempt charge as an independent criminal action, and the court has no jurisdiction to punish the defendant at this time. Phillips then reviewed and re-advised Crackenberger of the judgment and sentence from earlier this month. For the felony charge of delivery of a controlled substance – methamphetamine, Crackenberger was ordered to serve 3 to 6 years in prison, suspended in lieu of a split-sentence of 90-days in jail followed by three years of supervised probation. Crackenberger must also pay $350 in various court costs and $500 in public defender fees.
