Buffalo Man Arraigned on Sexual Abuse and Child Pornography Charges

A Sheridan man was arraigned on a number of charges related to child pornography Thursday in Fourth Judicial District Court. Sheridan Media’s Ron Richter has the details.

District Court Arraignment

Last month 27-year-old Kyle Barton of Buffalo was arrested and charged with two felonies and one misdemeanor for alleged illegal activity with a minor. Barton, at an arraignment hearing Thursday in District Court, pleaded not guilty to the charges of sexual abuse of a minor in the second degree, sexual exploitation of a child and promoting obscenity to a minor. The alleged crimes occurred this year between August 10 and the 18 in Sheridan County.

District Court Judge Darci Phillips scheduled a three-day jury trial to begin on March 4, 2024 and set the pretrial conference for February 8 at 9 am. A motion made by the defense to modify Barton’s bond from a $50,000 cash only bond to a $10,000 cash or surety bond was denied by the Court due to the nature of the charges. Sexual abuse of a minor in the second degree is a felony punishable by up to 20 years in prison and a fine of up to $10,000. Sexual exploitation of a child is a felony punishable by not less than 5 and not more than 12 years in prison and a $10,000 fine. Promoting obscenity to a minor is a misdemeanor punishable by up to one-year in jail and a fine of up to $6,000.

An arraignment hearing was held Thursday in District Court for 43-year-old Levi Eipert. During the hearing, Eipert pleaded not guilty to the charges of possession of a controlled substance with intent to deliver – methamphetamine, possession of a controlled substance in an amount greater than three grams, and conspiracy to deliver a controlled substance – methamphetamine. Eipert was in possession of 800 grams of methamphetamine when he was arrested by law enforcement.

District Court Judge Darci Phillips scheduled a three-day, #6 stack jury trial to begin on January 22, 2024. A pretrial conference in District Court will take place on December 19 at 10:30 am. If convicted on all three charges, Eipert faces up to 47 years in prison and fines of up to $65,000.
