A change of plea hearing was recently held in Fourth Judicial District Court in Sheridan for 31-year-old Joseph Murdock. Pursuant to the terms of a plea agreement reached with the State, Murdock pleaded guilty to the charges of felony DUI, misdemeanor possession of a controlled substance – cocaine, and misdemeanor interference with a peace officer.
The DUI charge is a felony because Murdock has had four DUI convictions in a 10 year period. The latest DUI will be his sixth overall conviction for driving under the influence. Murdock’s blood alcohol content was .22, which is almost three times the legal limit. The State is recommending a prison sentence of 3 to 7 years. Murdock can argue for a more lenient punishment at sentencing.
District Court Judge Darci Phillips ordered that a presentence investigation report be completed by the Department of Corrections Division of Probation and Parole. Murdock will be sentenced on June 25 at 9 am.
