U.S. Senator Cynthia Lummis, ranking member of the Fisheries, Water, and Wildlife Subcommittee and Chair of the Senate Western Caucus, issued a statement Thursday in response to the U.S. Supreme Court’s ruling in Sackett v. Environmental Protection, which ruled in favor of the petitioners and narrowed the Biden administration’s authority to define Waters of the United States (WOTUS).
Lummis said the administration clearly overreached its authority in defining which waters received federal protections and this ruling is a major win for farmers and ranchers in Wyoming, as it provides a regulatory clarity regarding what is and what is not covered under the EPA and the Army Corps of Engineers’ definition of a WOTUS. Lummis cosponsored a Congressional Review Act resolution to overturn the rule. In March, the Senate passed the CRA, which President Biden vetoed.
Senator Barrasso also released a statement saying that the Supreme Court ruled once again to rein in an out-of-control EPA and this ruling is a big win in the fight to stop federal overreach and protect Americans’ private property rights.
