A Sheridan man was sentenced for aggravated assault and battery at a hearing Tuesday in Fourth Judicial District Court. Sheridan Media’s Ron Richter has the details.
On October 9, 2024, 44-year-old Oscar Gaona was arrested by deputies with the Sheridan County Sheriff’s Office for aggravated assault and battery for threatening two individuals with a shotgun and firing the shotgun. In February of this year, Gaona, pursuant to a plea agreement reached with the State, pleaded guilty to one count of aggravated assault and battery. In exchange for the guilty plea, the State agreed to dismiss the other aggravated assault charge and recommend a sentence of 3 to 5 years in prison.
At sentencing Tuesday, District Court Judge Darci Phillips, citing the aggravated nature of the crime, deviated from the plea agreement and sentenced Gaona to 3 to 10 years in prison. Gaona was ordered to pay $325 in court costs and assessments and was given credit for 210 days for time served of presentence confinement.
